General Terms and Conditions (GTC) of the online store of BINOVA AG (Sohotree)

1. general

The General Terms and Conditions (GTC) apply to all services and products purchased via the www.sohotree.ch platform. By submitting an order, you expressly agree to these GTCs. The contract is concluded when we deliver the goods in fulfillment of the order. Cancellation of the order is possible at any time.

2. offer

The prices in our offers and order confirmations are always binding. Value added tax is included in all prices. Items that are not immediately available will be delivered later if possible. If an item is not available, we will contact you by e-mail or telephone. If the item is no longer available, the customer will receive a refund. BINOVA AG (Sohotree) always endeavors to provide correct product information. Most of this information is obtained directly from the manufacturers. Therefore, no liability can be assumed for the accuracy, completeness and timeliness of the information. BINOVA AG (Sohotree) reserves the right to change prices and product ranges at any time.

3rd delivery

The goods are sent by Swiss Post. Please check that the goods are correct, complete and undamaged upon arrival. Transport damage must be reported and documented immediately. BINOVA AG (Sohotree) endeavors to deliver all ordered items as quickly as possible. If products are in stock, the delivery period is 1-3 working days. BINOVA AG (Sohotree) is entitled to make partial deliveries. Subsequent deliveries will be sent free of charge. Free deliveries are limited to delivery addresses within Switzerland and the Principality of Liechtenstein. For delivery addresses outside Switzerland, a flat-rate shipping fee will be charged.

4. payment

Payments are accepted by credit card, PayPal, Twint, purchase on account, Apple Pay or prepayment. Orders with prepayment must be paid within 14 days. We do not charge any transportation fees for our customers.

4.1 Purchase on account with installment facility (POWERPAY)

MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the single invoice, you can simply pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept the GTC of POWERPAY in addition to our GTC. (powerpay.ch/en/agb).

5. loyalty programs / vouchers

Vouchers and discounts are only valid during the specified period and can only be redeemed once as part of an online order process.

6 Cancellation

Orders oblige the customer to accept the products. BINOVA AG (Sohotree) may accept subsequent changes or cancelations of customer orders at its own discretion. However, an order can only be canceled before the goods are shipped. After shipment, §7 Returns applies.

7. return

Returns must be made within 30 days of receipt of the goods by sending them to BINOVA AG (Sohotree). The goods must be in their original packaging and in perfect condition. Personalized products cannot be returned. The postage costs for returns shall be borne by the customer (CHF 8). A return order must be entered on the support page. BINOVA AG (Sohotree) reserves the right to block customers who refuse to accept returns.

8. data protection

All personal data is treated as strictly confidential and is only passed on to other companies for order processing. You can view and edit your user information at any time in the protected area of the homepage after logging in.

9. liability & guarantee

BINOVA AG (Sohotree) excludes any liability for the products sold and delivered to the extent permitted by law.

Our products are covered by a two-year warranty from the date of purchase, which covers material and product defects. Under this warranty, we accept responsibility for the following defects in our leather products:

  • Tearing open seams
  • Material cracks
  • Defective zippers

However, the guarantee does not cover the following circumstances:

  • Fading of the "SOHOTREE" embossing
  • Natural discoloration of the leather
  • Damage caused by improper use, improper care or repairs by third parties
  • Normal wear and tear
  • Damage caused by external influences such as water, fire or chemicals

In the event of a warranty claim, please contact us with proof of the date of purchase and a detailed description of the defect. We will assess the defect and endeavor to find a solution, which may include repair or replacement of the product. This warranty does not affect your statutory rights as a consumer.

10. final provisions

All legal relationships are subject to Swiss law. BINOVA AG (Sohotree) reserves the right to change these general terms and conditions at any time. The binding version of the GTC can be viewed and printed at www.sohotree.ch. The place of jurisdiction is the registered office of the company.
